These Terms and Conditions ("Terms") govern your access to and use of 3dtrinketry.au (the "Site") and the purchase of any goods from us through the Site.
The Site is operated by 3D TRINKETRY (ABN 24 829 670 891) ("we", "us", "our").
By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
Before You Buy — A Plain English Summary
This summary is provided for convenience and transparency. It is not a substitute for the full Terms below, which prevail if there is any inconsistency.
- Our Goods are 3D printed to order. They are made by hand, one at a time, and are not mass-produced. Small variations are normal and expected — see clause 5.
- Miniatures are supplied unpainted and unassembled unless a listing says otherwise. Photographs usually show professionally painted examples.
- Our Goods are collectors' and hobby items, not toys. They contain small, sharp and brittle parts and are not suitable for children under [14] years — see clause 6.
- Because items are made to order, we cannot accept change of mind returns once printing has begun — see clause 14.
- None of this affects your rights under the Australian Consumer Law, which apply no matter what these Terms say — see clause 15.

2. Eligibility
2.1 You must be at least 18 years old and have the legal capacity to enter into a binding contract to place an Order. If you are under 18, you may only use the Site with the involvement of a parent or guardian.
2.2 By placing an Order, you warrant that the information you provide is true, accurate, current and complete.
2.3 Our Goods are intended for hobbyists, collectors and adult purchasers. Please see clause 6 regarding suitability for children.
3. Your Account
3.1 You may need to create an account to place an Order. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3.2 You must notify us promptly at customer.service@3dtrinketry.au if you suspect any unauthorised use of your account.
3.3 We may suspend or cancel your account if we reasonably believe you have breached these Terms, or where required to protect the security of the Site or other users. Where practicable, we will give you notice and an opportunity to remedy the issue first.
4. Goods, Descriptions and Availability
4.1 We take reasonable care to describe and depict our Goods accurately. Please read clause 5, which explains the characteristics that are inherent to 3D printing, before you purchase.
4.2 Painted examples. Photographs on the Site frequently show miniatures that have been professionally painted, assembled and based for display purposes only. Unless a listing expressly states that a Good is supplied painted, the Good you receive will be unpainted, unassembled and unbased, in the raw colour of the Resin or filament used. Paint, primer, glue, bases and hobby supplies are not included unless listed.
4.3 Scale and dimensions. Miniatures are supplied in the scale stated in the listing (for example, 28mm or 32mm "heroic" scale). Scale references in this hobby are conventions rather than exact ratios. All dimensions, heights and weights given are approximate and are measured to the point stated in the listing. Height measurements typically exclude the base unless stated.
4.4 Colour. The colour of the Resin or filament shown on screen is indicative only. Screen calibration, lighting and photography affect how colours appear. Where you select a colour, minor variation between production batches and filament dye lots is normal.
4.5 Colour substitution. If your selected colour becomes unavailable, we will contact you before printing and offer you the choice of an alternative colour, a delay until stock arrives, or cancellation with a full refund. We will not substitute a colour without your agreement.
4.6 Multi-part kits. Some Goods are supplied as multi-part kits requiring assembly with adhesive (not supplied). Where this is the case, the listing will say so and will state the approximate number of parts.
4.7 Availability. All Goods are subject to availability, materials on hand and printer capacity. We may withdraw or discontinue any Goods, or limit quantities available for purchase, at any time before we accept your Order.
4.8 Compatibility statements. Where a listing describes a Good as "compatible with", "suitable for", "scaled for" or "proxy for" a particular game, system or product, that statement is descriptive only, to help you assess size and fit. It does not imply that we are affiliated with, licensed by, endorsed by or sponsored by the owner of that game, system, product or brand. All third-party names and trade marks remain the property of their respective owners.
5. The Nature of 3D Printed Goods
5.1 Please read this clause carefully. Our Goods are produced individually using additive manufacturing. They are hand-finished hobby items, not injection-moulded mass-produced products. The characteristics described in this clause are inherent and unavoidable features of the 3D printing process, are normal for goods of this kind, and are specifically drawn to your attention before you agree to purchase. They are not defects.
5.2 Characteristics common to all our Goods:
- (a) faint layer lines or stepping, particularly on curved, sloped or large flat surfaces;
- (b) small marks, nubs, pips or slight roughness where printing supports were attached and removed;
- (c) minor blemishes, seams or surface texture variation;
- (d) small variations in dimensions, typically within [±0.5mm], between individual copies of the same model;
- (e) minor variation in colour and finish between production batches; and
- (f) the need for light cleanup — trimming, sanding or filing — before painting, which is a normal part of hobby preparation.
5.3 Resin Goods additionally may exhibit:
- (a) fine support marks on the underside or rear of the model;
- (b) slight translucency or colour shift depending on the Resin used and curing;
- (c) brittleness — cured Resin is rigid and fine details such as spears, swords, antennae, tails and outstretched limbs can snap if dropped, flexed or handled roughly; and
- (d) gradual yellowing or embrittlement if exposed to prolonged direct sunlight or ultraviolet light.
5.4 FDM Goods additionally may exhibit:
- (a) visible layer lines as a normal feature of the process;
- (b) small amounts of stringing, elephant's foot, or minor surface artefacts;
- (c) slightly softer detail resolution than Resin equivalents; and
- (d) softening or warping if exposed to heat — see clause 6.5.
5.5 No two prints are identical. Because each Good is printed and finished individually, the Good you receive will vary slightly from the photographs and from other copies of the same model. This is a characteristic of handmade goods.
5.6 Nothing in this clause 5 limits your rights under the Consumer Guarantees. A Good that arrives broken, incomplete, badly malformed, misprinted, incorrectly sized, warped beyond the tolerances above, or otherwise not of acceptable quality is not covered by this clause and you should contact us under clause 13 or clause 15.
6. Product Safety, Care and Suitability
6.1 Not a toy. Our Goods are collectors', display and hobby items. They are not toys and are not designed, tested or marketed for use by children. They are not suitable for children under 14 years of age and must be kept away from children under 3 years of age at all times.
6.2 Choking and injury hazard. Goods contain, or may break into, small parts. Many models have sharp points and thin, brittle projections. Small parts present a choking hazard to young children. Adult supervision is required wherever children may have access to the Goods.
6.3 Cured Resin. Our Resin Goods are washed and fully UV-cured before dispatch. Cured Resin is inert in normal handling. However, a small number of people are sensitive to photopolymer materials. We recommend you wash your hands after extended handling, and avoid prolonged skin contact. Do not sand, cut or drill Resin Goods without appropriate eye protection and a dust mask, and do not inhale the dust. Keep Resin Goods away from pets.
6.4 Not food safe and not for skin contact. No Good we supply — Resin or FDM — is food safe, watertight, dishwasher safe, microwave safe, or suitable for holding food, drink, cosmetics, or anything intended to be consumed or applied to the body. Printed layer lines harbour bacteria and cannot be reliably sanitised. Do not use any Good as, or as part of, a drinking vessel, food container, utensil, or item worn against broken skin.
6.5 Heat. FDM Goods printed in PLA can soften and deform at temperatures above approximately 60°C. Do not leave any Good in a parked car, on a windowsill, near a heater, or in direct summer sun. Damage caused by heat exposure after delivery is not a manufacturing defect.
6.6 Care. Store Goods away from direct sunlight and extreme temperatures. Clean with a soft dry brush. Do not soak Goods in water, isopropyl alcohol or solvents unless you accept the risk of damage. Use hobby paints and primers suitable for the material.
6.7 Electrical and battery-powered items. Where a Good contains, is supplied with, or is designed to house a battery, LED or other electrical component, additional safety information will be supplied with it and must be followed. Button and coin batteries are extremely dangerous if swallowed and can cause severe internal injury or death within hours. Any such item is supplied with a secured battery compartment and warnings as required by the applicable Australian mandatory safety and information standards. Keep spare and used batteries out of reach of children and seek immediate medical attention (Poisons Information Centre 13 11 26) if swallowing is suspected.
6.8 Safety notices. If we become aware of a safety issue affecting a Good you have purchased, we will contact you using the details on your Order and comply with our obligations under Australian product safety law.
6.9 You are responsible for using the Goods safely and for their intended purpose as a display and hobby item.
7. Prices and GST
7.1 All prices are shown in Australian dollars (AUD) and, unless stated otherwise, are inclusive of GST where GST applies.
7.2 Prices exclude delivery charges, which are calculated and displayed at checkout before you submit your Order.
7.3 We may change prices at any time, but changes will not affect Orders we have already accepted.
7.4 Pricing errors. Despite our best efforts, a small number of Goods may be incorrectly priced due to a technical, typographical or human error. If we identify a pricing error in an Order we have accepted, we will contact you before printing or dispatch and give you the option to confirm the Order at the correct price or cancel it for a full refund. We will not treat an obvious pricing error as binding on us where a reasonable person would have recognised it as an error.
7.5 A tax invoice will be issued with your Order in accordance with GST requirements.
8. Orders and Formation of Contract
8.1 Your submission of an Order is an offer to purchase the Goods on these Terms.
8.2 Our automated acknowledgement email confirming receipt of your Order is not acceptance of your offer.
8.3 Made to order Goods. Because most of our Goods are printed to order, a binding contract is formed when we send you an email confirming that your Order has been accepted and scheduled for production. From that point, clause 9 applies.
8.4 In-stock Goods. For Goods we hold in stock and identify as such, a binding contract is formed when we dispatch the Goods to you.
8.5 We may accept your Order in part.
8.6 We may decline or cancel an Order (in whole or in part) before production or dispatch where:
- (a) the Goods, materials or colours are unavailable;
- (b) there is an error in the price or description of the Goods;
- (c) your payment is declined or we cannot verify it;
- (d) we reasonably suspect fraud or a breach of these Terms;
- (e) the Order would require us to infringe a third party's intellectual property rights or breach a licence we hold;
- (f) the delivery address is outside our delivery area; or
- (g) we are unable to supply for reasons beyond our reasonable control.
8.7 If we cancel an Order after payment, we will refund the amount paid in full to your original payment method.
9. Made to Order Production, Lead Times and Pre-Orders
9.1 Production time is separate from delivery time. The estimated dispatch window shown on a listing or at checkout is the time we expect to take to print, cure, clean, finish and pack your Order before it is handed to the carrier. Delivery time is additional — see clause 12.
9.2 Our typical estimated production time is 2-4 business days. Larger Orders, large-format models, multi-colour prints and Custom Orders take longer, and we will tell you if that applies to your Order.
9.3 Print failures. 3D printing sometimes fails, and a model may need to be reprinted. Where this causes a material delay, we will contact you as soon as reasonably practicable with a revised estimate, and you may choose to wait or cancel that item for a full refund.
9.4 Changing or cancelling a made to order item. You may change or cancel a made to order item free of charge at any time before production begins. Once production has begun, we can only cancel by agreement, and we may retain an amount equal to our reasonable costs actually incurred to that point (materials consumed, machine time and labour). We will tell you that amount before you decide, and we will refund the balance.
9.5 Pre-orders and batch runs. Where a listing is marked as a pre-order or a scheduled batch run, the dispatch date shown is an estimate only. If dispatch is delayed by more than 14 days beyond the estimate, you may cancel the pre-order and receive a full refund of amounts paid. This is in addition to your right under the Consumer Guarantees to have Goods supplied within a reasonable time.
9.6 We will not begin production on an Order until payment has been received in full, unless we agree otherwise in writing.
10. Custom Orders and Customer-Supplied Files
This clause applies only if we offer, and you place, a Custom Order.
10.1 Quotation. Custom Orders are quoted individually. A quotation is valid for 14 days and is based on the files, specifications and material you provide at the time.
10.2 Your warranties. By submitting Digital Files or a custom request, you warrant that:
- (a) you own the intellectual property in the Digital Files, or hold a licence that expressly permits you to have physical copies printed by a third party for your intended use;
- (b) printing the Digital Files will not infringe any person's copyright, design right, trade mark, patent, moral rights or other rights; and
- (c) the Goods requested are lawful in your State or Territory and are not a prohibited item under clause 10.4.
10.3 Indemnity. You indemnify us against any claim, loss, damage or cost we reasonably incur arising from a breach of the warranties in clause 10.2. We are not obliged to review, verify or investigate the provenance of any Digital File you supply, and we do not do so.
10.4 Prohibited items. We will not print, and you must not ask us to print, any item that is or resembles:
- (a) a firearm, firearm part, firearm component, magazine, suppressor, receiver or frame, whether functional or not;
- (b) any weapon or prohibited weapon under Commonwealth, State or Territory law, including knuckledusters, knives designed as weapons, or concealed weapons;
- (c) any item designed to defeat a lock, security device, ticketing system, gaming machine or payment terminal;
- (d) counterfeit goods, or items bearing a trade mark you are not authorised to use;
- (e) medical, dental, safety-critical, load-bearing, structural, automotive or aviation components;
- (f) child abuse material or material that is refused classification under Australian law; or
- (g) anything else we consider unlawful, unsafe or contrary to our licences.
We may refuse any Custom Order at our discretion and without explanation, and we may report a request to law enforcement where we are required or permitted by law to do so.
10.5 Proofs and approval. Where the Custom Order warrants it, we will supply you with a render, slice preview or photograph for approval before printing. Once you approve, you accept the model as shown, including its orientation, support placement, scale and part breakdown. We are not responsible for defects that were apparent in an approved proof.
10.6 File quality. We are not responsible for defects in the finished Good that result from problems in the Digital Files you supply, including non-manifold geometry, inverted normals, wall thicknesses below printable limits, unsupported overhangs, or details too fine to reproduce in the chosen material. Where we identify such an issue in advance we will tell you, and we may offer to repair the file at our standard rate.
10.7 Revisions. Your quotation includes 2 rounds of revision before printing. Further revisions are charged at a re-quoted rate.
10.8 Deposit and cancellation. Custom Orders require a deposit of 50% to be scheduled. If you cancel after production begins, we may retain an amount equal to our reasonable costs actually incurred, and we will refund the balance.
10.9 No change of mind returns. Custom Orders are made specifically to your requirements and are not eligible for change of mind returns under clause 14. Your rights under the Consumer Guarantees are unaffected.
10.10 Retention of files. We retain your Digital Files for 90 days to enable reprints and warranty claims, after which they are securely deleted. We will not use, print, sell, publish or share your Digital Files for any purpose other than fulfilling your Order.
11. Payment
11.1 We accept the payment methods displayed at checkout. Payment must be received in full and cleared before production begins.
11.2 Payments are processed by third-party payment providers (e.g. Stripe, PayPal, Afterpay, Zip). Your use of those services is subject to their own terms and privacy policies. We do not store your full card details.
11.3 If we apply a payment surcharge, it will be disclosed before you complete payment and will not exceed our reasonable cost of accepting that payment method.
11.4 You must not use a payment method you are not authorised to use. Chargebacks initiated without first contacting us to resolve the issue may result in suspension of your account.
12. Delivery
12.1 We deliver to addresses within Australia, including PO Boxes and parcel lockers.
12.2 Delivery timeframes and charges shown on the Site are estimates only and run from dispatch, not from the date of your Order. They may be affected by carrier delays, remote locations, public holidays and peak periods.
12.3 If we become aware that delivery will be materially delayed, we will let you know as soon as reasonably practicable. If a delay is unreasonable in the circumstances, you may be entitled to a remedy under the Consumer Guarantees (see clause 15).
12.4 Packaging. Because miniatures are fragile, we pack Goods with protective materials appropriate to their fragility. Multi-part kits are packed as separate parts on the sprue or in bags.
12.5 Risk and title. Risk in the Goods passes to you on delivery to the address you nominate. Title in the Goods passes to you when we receive payment in full.
12.6 Authority to leave. If you (or your carrier instructions) authorise the carrier to leave a parcel unattended, risk passes on delivery to that address and we are not responsible for loss or theft after that point, to the extent permitted by law. We recommend a signature-on-delivery or parcel locker option for fragile Orders.
12.7 Incorrect address. If you provide an incorrect or incomplete delivery address, you may be responsible for redelivery costs.
12.8 International orders. You are the importer of record and are responsible for all import duties, taxes and customs charges. We are not responsible for delays caused by customs clearance.
13. Damaged, Incorrect or Missing Items
13.1 Please open and inspect your Order promptly on delivery.
13.2 If any item arrives broken, damaged, misprinted, incorrect or missing, contact us at customer.service@3dtrinketry.au within 7 days of delivery with:
- (a) your order number;
- (b) clear photographs of the affected item, including any broken parts; and
- (c) photographs of the outer packaging and internal packing materials if the item appears to have been damaged in transit.
13.3 We will assess the claim promptly and, where the claim is valid, arrange a reprint, replacement part, or refund. For a snapped spear, weapon or similarly small component, we will usually reprint and post the replacement part at no cost to you.
13.4 We may ask you to return the item for assessment. Where a valid claim is made, we will reimburse your reasonable return costs.
13.5 The timeframe in clause 13.2 helps us resolve claims quickly and pursue carrier claims. It does not limit your rights under the Consumer Guarantees, which apply for a reasonable period after purchase regardless of this clause.
13.6 We are not responsible for damage caused after delivery, including breakage during your own assembly, painting, stripping, sanding or handling, or damage caused by heat or sunlight exposure (see clause 6.5).
14. Change of Mind Returns
14.1 Because our Goods are printed to order, we are generally unable to accept change of mind returns once production has begun. Please see clause 9.4 for cancelling before production.
14.2 For any Goods we hold in stock and dispatch from stock, we offer a change of mind return within 7 days of delivery, provided the Goods are:
- (a) unused, unpainted, unprimed, unassembled and unmodified;
- (b) in their original, undamaged packaging with all parts and inserts; and
- (c) accompanied by proof of purchase.
14.3 Change of mind returns on in-stock Goods are provided as a refund or store credit. Original and return delivery charges are non-refundable / at your cost unless we state otherwise.
14.4 The following Goods are not eligible for change of mind returns in any circumstances:
- (a) made to order Goods on which production has begun;
- (b) Custom Orders and personalised items;
- (c) Goods that have been primed, painted, glued, assembled, sanded, magnetised or otherwise modified;
- (d) gift cards;
- (e) any Digital Files or downloads; and
- (f) clearance or final-sale items clearly marked as such.
14.5 To request a return, contact us at customer.service@3dtrinketry.au with your order number. Please do not send Goods back before receiving return instructions.
14.6 This change of mind policy is in addition to, and does not limit, your rights under the ACL.
15. Australian Consumer Law and Consumer Guarantees
15.1 Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
15.2 Nothing in these Terms — including clauses 5, 6, 13 and 14 — excludes, restricts or modifies any Consumer Guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
15.3 Acceptable quality. In assessing whether our Goods are of acceptable quality, regard is had to the nature of the Goods as individually 3D printed hobby items, their price, their description, and the characteristics specifically drawn to your attention in clause 5 before you agreed to purchase.
15.4 Major failure. Where there is a major failure, you may choose between a refund, a replacement, or keeping the Good and seeking compensation for the drop in value. A failure is major where, for example, the Good is unsafe, is substantially unfit for its ordinary purpose and cannot easily be made fit within a reasonable time, or differs significantly from the description, sample or demonstration model.
15.5 Minor failure. Where the failure is not major, we may choose to repair, replace or refund within a reasonable time. If we take too long, you may seek a remedy elsewhere and recover reasonable costs from us, or reject the Good.
15.6 Repairs and replacements. Given the nature of our Goods, our usual remedy for a minor failure is a reprint of the affected model or part. We may repair a Good — for example by re-curing, re-gluing or replacing a component — where that is appropriate and you agree.
15.7 We may ask you to provide proof of purchase and to return the Good for assessment. Where a valid claim is made, we will reimburse your reasonable costs of returning the Good.
15.8 The Consumer Guarantees do not apply where a fault has been caused by misuse, abnormal use, accidental damage, failure to follow the care instructions in clause 6, modification by you or a third party, or normal wear and tear.
16. Gift Cards and Promotions
16.1 Gift cards issued by us are valid for at least 3 years from the date of issue, in accordance with the ACL, and no post-supply fees apply.
16.2 Gift cards are not redeemable for cash and cannot be reloaded unless we state otherwise.
16.3 Promotional codes and discounts are subject to their own terms, are available for a limited time, may not be combined with other offers, and may be withdrawn at any time before an Order is placed.
16.4 We may cancel Orders where a promotional code has been obtained, used or shared in a manner we reasonably consider fraudulent or contrary to the offer's terms.
17. Intellectual Property
Our Site
17.1 All content on the Site — including text, graphics, logos, product photography, video, software, page layout and design — is owned by us or our licensors and is protected by Australian and international copyright and trade mark laws.
17.2 You may access and view the Site content for your personal, non-commercial use. You must not reproduce, adapt, publish, distribute, frame, scrape or commercially exploit any Site content without our prior written consent.
The Designs We Print
17.3 Every design we print is either our own original work, a design in the public domain, or a design we print under a commercial or merchant licence granted by the designer. We take our licensing obligations seriously and print only within the scope of the licences we hold.
17.4 Where a design was created by a third-party designer, the designer retains all intellectual property rights in that design. Nothing you purchase transfers those rights to you.
What You May and May Not Do With What You Buy
17.5 When you buy a Good, you buy that physical item only. You may keep it, paint it, convert it, modify it, magnetise it, photograph it, display it, game with it, gift it, and resell that individual physical item.
17.6 No Digital Files are supplied with any purchase. We do not sell, licence or provide 3D model files, meshes, STLs or sliced files with our Goods, and buying a Good does not give you any licence to the underlying design.
17.7 You must not, without the rights holder's written permission:
- (a) reproduce, copy or re-print any Good;
- (b) mould, cast, recast, or make a silicone or resin copy of any Good;
- (c) 3D scan, photogrammetry-capture, or otherwise digitise any Good to create a Digital File;
- (d) mass-produce or commercially reproduce any Good; or
- (e) use our product photography or descriptions in your own listings.
17.8 Recasting and unauthorised reproduction cause real harm to independent designers.
Trademarks
17.9 Our trademarks and business names must not be used without our prior written consent. Third-party game systems, brands and trademarks referred to on the Site remain the property of their respective owners, and clause 4.8 applies.
Intellectual Property Complaints
17.10 If you believe a design offered on the Site infringes your intellectual property rights, please contact us at legal@3dtrinketry.au with:
- (a) your name and contact details;
- (b) identification of the design and the URL of the listing;
- (c) a description of the right you own and evidence of your ownership; and
- (d) a statement that you believe in good faith that the use is not authorised.
17.11 We will investigate promptly and, where appropriate, remove the listing pending resolution. We will notify the designer or supplier concerned and give them an opportunity to respond. We may reinstate a listing where we are satisfied the use is authorised.
18. Acceptable Use
You must not:
- (a) use the Site for any unlawful purpose or in breach of any Australian law;
- (b) interfere with or disrupt the Site, its servers, or its security features;
- (c) use any robot, spider, scraper or automated means to access the Site or harvest data;
- (d) attempt to gain unauthorised access to any part of the Site or any other user's account;
- (e) transmit any virus, malware or harmful code;
- (f) impersonate any person or misrepresent your affiliation with any person or entity;
- (g) upload any Digital File in breach of clause 10.2 or 10.4; or
- (h) purchase Goods for the purpose of recasting, reproduction or commercial resale in breach of clause 17.7.
19. Reviews and User Content
19.1 If you submit reviews, ratings, images (including photographs of models you have painted), comments or other content ("User Content"), you grant us a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, adapt and display that User Content in connection with our business, including in marketing and on social media, with attribution to your username where practicable.
19.2 You warrant that your User Content is your own, is accurate, and does not infringe any third party's rights or breach any law.
19.3 We may moderate, edit or remove User Content that is unlawful, defamatory, misleading, offensive or otherwise inappropriate. We do not edit or selectively publish reviews in a way that would create a misleading impression.
19.4 If you would prefer we did not use a photograph you have shared, tell us at customer.service@3dtrinketry.au and we will stop using it.
20. Third Party Links
The Site may contain links to third-party websites, including designers' pages, hobby suppliers and community forums. Those links are provided for convenience only. We do not control, endorse or accept responsibility for third-party sites, their content, or their products and services.
21. Privacy
21.1 We collect, use, store and disclose your Personal Information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and our Privacy Policy which forms part of these Terms.
21.2 By placing an Order, you consent to us disclosing your Personal Information to our delivery partners, payment providers and other service providers for the purpose of fulfilling your Order.
21.3 Marketing. We will only send you commercial electronic messages in accordance with the Spam Act 2003 (Cth). Every marketing message includes a functional unsubscribe facility, and we will action unsubscribe requests within 5 business days.
21.4 Our use of cookies and similar technologies is described in our Privacy Policy.
22. Site Availability
22.1 We aim to keep the Site available at all times, but we do not guarantee uninterrupted or error-free access. The Site may be unavailable during maintenance, upgrades, or due to matters outside our reasonable control.
22.2 We may modify, suspend or discontinue any part of the Site at any time.
23. Liability
23.1 Nothing in this clause 23 limits or excludes:
- (a) the Consumer Guarantees or any other right or remedy under the ACL that cannot lawfully be excluded; or
- (b) our liability for death or personal injury caused by our negligence, or for fraud.
23.2 Where we are permitted by law to limit our liability for a breach of a Consumer Guarantee in relation to goods or services not of a kind ordinarily acquired for personal, domestic or household use or consumption (for example, wholesale supply to a retailer), our liability is limited, at our option, to:
- (a) for goods: replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing any of those things; and
- (b) for services: resupplying the services or paying the cost of having them resupplied.
23.3 Subject to clauses 23.1 and 23.2, and to the maximum extent permitted by law, our total aggregate liability to you arising out of or in connection with these Terms or your use of the Site is limited to the amount you paid for the Goods giving rise to the claim.
23.4 Subject to clauses 23.1 and 23.2, and to the maximum extent permitted by law, we are not liable for any indirect, special or consequential loss, loss of profit, loss of revenue, loss of opportunity, loss of data, or loss of anticipated savings.
23.5 To the maximum extent permitted by law, we are not liable for loss or damage arising from your use of a Good otherwise than as a display or hobby item, contrary to clause 6.
24. Indemnity
To the maximum extent permitted by law, you indemnify us against any loss, damage, cost or expense we reasonably incur arising from your breach of these Terms, your unlawful use of the Site, your breach of clause 10.2 or 17.7, or your infringement of a third party's rights. This indemnity does not apply to the extent the loss was caused or contributed to by us.
25. Force Majeure
We are not liable for any failure or delay in performing our obligations where that failure or delay results from an event beyond our reasonable control, including natural disaster, fire, flood, pandemic, epidemic, war, terrorism, industrial action, carrier failure, equipment failure, materials shortage, power or telecommunications outage, or government action. If the event continues for more than 30 days, either party may cancel the affected Order and we will refund any amounts paid for undelivered Goods.
26. Dispute Resolution
26.1 If you have a concern, please contact us first at customer.service@3dtrinketry.au. We aim to acknowledge complaints within 2 business days and resolve them within 10 business days.
26.2 If we cannot resolve the matter, both parties agree to attempt to resolve the dispute in good faith through negotiation before commencing proceedings. This clause does not prevent either party from seeking urgent interlocutory relief.
26.3 Nothing in this clause limits your right to contact the Australian Competition and Consumer Commission (ACCC) or your state or territory consumer protection agency (for example, NSW Fair Trading, Consumer Affairs Victoria, or the Queensland Office of Fair Trading).
27. Changes to These Terms
27.1 We may update these Terms from time to time. The current version will always be published on the Site with the "Last updated" date.
27.2 The Terms that apply to an Order are those in force at the time you place that Order. Changes to these Terms do not apply retrospectively to Orders we have already accepted.
28. General
28.1 Governing law. These Terms are governed by the laws of Western Australia. You and we submit to the non-exclusive jurisdiction of the courts of that State or Territory and the courts hearing appeals from them. Nothing in this clause prevents you from bringing proceedings in your own State or Territory where the law permits.
28.2 Severability. If any provision of these Terms is found to be invalid, unenforceable or void, it is severed and the remaining provisions continue in full force.
28.3 Waiver. A failure or delay by us in exercising a right is not a waiver of that right.
28.4 Assignment. You may not assign your rights under these Terms without our written consent. We may assign or novate our rights and obligations on notice to you, provided your rights are not materially prejudiced.
28.5 Entire agreement. These Terms, together with our Privacy Policy and any policies referred to in them, constitute the entire agreement between you and us in relation to the Site and your Orders.
28.6 Notices. Notices to you will be sent to the email address associated with your account. Notices to us should be sent to customer.service@3dtrinketry.au.
